Policies
By booking with Lexi Grady Photography, Client acknowledges, understands, and agrees to be bound by the following policies. These policies are incorporated into all bookings and are legally binding upon payment of any retainer or invoice, regardless of whether Client has reviewed these policies in full. Booking constitutes acceptance of all terms herein.
Retainer & Payment
A non-refundable retainer is required to reserve a session or event date. No date will be held without receipt of the retainer. The remaining balance must be paid in full by the agreed-upon due date. Failure to remit payment may result in cancellation of services without further notice, and any payments made will be forfeited.
No Refunds
All payments made to Photographer, including but not limited to retainers, session fees, and installment payments, are strictly non-refundable under any circumstances. Upon booking, Photographer removes the reserved date from availability and may decline other potential clients, resulting in a loss of business opportunities.
Cancellations
Should Client cancel this booking for any reason, all payments made to Photographer shall be forfeited and retained as liquidated damages. Such cancellation shall not relieve Client of any outstanding financial obligations unless otherwise agreed to in a written document signed by Photographer.
Rescheduling
Rescheduling requests are subject to Photographer’s sole discretion and availability. If approved, payments may be transferred to a new date within a reasonable timeframe designated by Photographer. Approval of rescheduling does not guarantee future availability and may be denied for any reason.
Late Arrivals
Client understands and agrees that late arrival will result in a reduction of session time. Sessions will conclude at the originally scheduled end time regardless of Client’s arrival time. No additional time will be added.
Creative Control
Client acknowledges familiarity with Photographer’s portfolio and artistic style. Photographer retains full and complete creative control over all aspects of the session, including but not limited to composition, posing, editing, and final image selection. Final delivered images will reflect Photographer’s professional judgment and style, which is not subject to revision.
Turnaround Time
Delivery timelines are estimates only and are not guaranteed. Photographer shall not be held liable for delays caused by workload, peak seasons, technical issues, or circumstances beyond Photographer’s control.
Image Delivery & Files
Final edited images will be delivered via an online gallery. RAW or unedited files remain the sole property of Photographer and will not be provided under any circumstances. Client acknowledges that refusal to release unedited files is standard industry practice.
Usage & Copyright
Photographer retains full copyright and ownership of all images created. Client is granted a limited, non-exclusive, non-transferable license for personal use only. Images may not be altered, sold, published, or used for commercial purposes without prior written consent. Photographer reserves the right to use images for portfolio, marketing, advertising, and promotional purposes unless otherwise agreed upon in writing prior to the session.
Non-Disparagement
Client agrees not to make, publish, or communicate any false, misleading, defamatory, or disparaging statements regarding Photographer, its services, or its business practices. This includes, but is not limited to, statements made on social media, review platforms, or in any public or private forum. Client agrees to address any concerns directly with Photographer and allow a reasonable opportunity for resolution prior to making any public statement.
Nothing in this clause prohibits truthful statements or lawful reviews; however, any knowingly false statements, misrepresentations, or actions intended to harm the reputation or business of Photographer may result in legal action, including but not limited to claims for damages.
